Terms of Use

These Terms of Use ("Terms") govern your use of the Corail: Surf Crew Journal app (the "App"), published by Raphael Chelly, based in France ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The service

Corail: Surf Crew Journal is a mobile app that lets you log your surf sessions, see what your crew surfed, and keep a surfer profile built from your sessions. We may change, suspend, or discontinue all or part of its features at any time, in particular for technical, security, or product reasons.

2. Your account

An account is required to use the App. You are responsible for keeping your login credentials confidential and for activity that occurs under your account. You agree to provide accurate information and to keep it up to date. You can close your account at any time.

3. License

We grant you a personal, limited, non-exclusive, non-transferable license to use the App on devices you own or control, subject to these Terms and to the rules of the platform, including the App Store or Google Play. This license gives you no ownership rights in the App.

4. Acceptable use

You agree not to:

• circumvent, disable, or interfere with the App's security features;
• decompile, disassemble, or attempt to extract the source code, except as permitted by law;
• use the App for unlawful or fraudulent purposes, or in a way that infringes the rights of others;
• overload or disrupt our servers and infrastructure, for example through abusive automated requests;
• upload content that is illegal, infringing, or harmful, or that you do not have the right to share.

5. Your content

You keep ownership of the content you create or import, including journal entries, session logs, and photos. You grant us a limited license to host and display that content for the sole purpose of operating the service, including sharing it with the crew members you choose. You are responsible for the content you provide and confirm you have the rights needed to share it.

6. Intellectual property

The App, its name, design, text, logos, and content, other than user content, are protected and remain our property or that of our partners. Nothing in these Terms transfers those rights to you.

7. Availability and no warranty

The App is provided "as is" and "as available". To the extent permitted by law, we do not warrant that the App will be error-free, available without interruption, or fit for a particular purpose. Information shown in the App is provided for guidance only and is not a substitute for your own judgment, especially in situations where your safety is at stake, such as ocean and surf conditions.

8. Limitation of liability

To the extent permitted by law, we will not be liable for indirect, incidental, or consequential damages arising from the use of, or inability to use, the App. This clause does not limit liabilities that cannot lawfully be excluded, including under consumer protection law.

9. Termination

You may stop using the App and uninstall it at any time. We may suspend or terminate your access if you breach these Terms.

10. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, and after attempting an amicable resolution, you may, as a consumer, use a consumer mediation service free of charge. Failing agreement, the competent French courts will have jurisdiction, without prejudice to the protective rules applicable to consumers in their country of residence.

11. Changes

We may modify these Terms. If we make a material change, we will update the date at the top of this page. Continued use after an update means you accept the revised Terms.
